Bioabundance files with High Court Re: Local Plan 2035

On Thursday 21st of January 2021, Bioabundance issued a legal claim against South Oxfordshire District Council, concerning the decision by the Council to go ahead with the Local Plan 2035. Robert Jenrick, the Secretary of State at the Ministry of Housing, Communities and Local Government (MHCLG) was named as an interested party.

We hope for the plan to be quashed under s.113 of the Planning and Compulsory Purchase Act 2004. The grounds for challenge are that:

  • the worsening effect on climate change of excessive housing numbers is not given adequate attention
  • the calculation of housing numbers is not coherent
  • at the adoption vote, councillors unlawfully took account of threatened consequences of government intervention, and the vote was dictated by MHCLG
Ian Ashley (one of our directors) says “Local community groups, some of whom have fought this plan for years, are now joining Bioabundance and are delighted that this action is being brought forward”.
